Subject: Update on Letter from Oneil Atkins regarding property situate at 30 Industrial Estate Ruimveldt
The abovementioned property is currently being controlled for allocation/conveyance through the National Industrial and Commercial Investments Limited (NICIL), a Government of Guyana owned company.
The property was given to Mr. Clarence Gibbs over 40 years ago. The heirs of the estate of Clarence Gibbs are seeking to acquire the property they have been using during the said period of time for business purposes.
The heirs of the estate of Clarence Gibbs instituted a Petition for a Declaration of Title in the Land Court by Petition No. 1113-P/2008. The Petition was opposed by NICIL and judgment was granted in NICIL’s favour. The matter is currently in the jurisdiction of the Court of Appeal in Civil Appeal 35 of 2013.
The Central Authority has no jurisdiction in the said property and as such a response should be sent to Mr. Oneil Atkins stating the same.
The above information was confirmed by NICIL and the Court of Appeal on 21st and 22nd July 2016.
